These Terms and Conditions ("Terms") govern your use of the Faces Events mobile application (the "App") operated by Faces Events (Pty) Ltd ("Faces", "we", "us", or "our"). By downloading, installing, or using the App, you agree to be bound by these Terms.

1. Acceptance of Terms

By accessing or using the App, you confirm that you are at least 18 years of age and agree to comply with these Terms. If you do not agree, do not use the App.

2. Account Registration

• You must provide accurate and complete information when creating an account.
• You are responsible for maintaining the confidentiality of your login credentials.
• You agree to notify us immediately of any unauthorised use of your account.
• We reserve the right to suspend or terminate accounts that violate these Terms.

3. Use of the App

The App provides access to event registration information, live tracking during events, event results, and related services. You agree to use the App only for its intended purposes and not to:

• Use the App for any unlawful purpose.
• Attempt to gain unauthorised access to our systems or other users' accounts.
• Interfere with or disrupt the App's functionality.
• Reverse engineer, decompile, or disassemble any part of the App.
• Use automated systems or bots to access the App.

4. Live Tracking

The Live Tracking feature allows your GPS position to be shared in real time during events. By enabling Live Tracking, you acknowledge and agree that:

• Your location, name, and event details will be publicly visible to anyone with the spectator link.
• Location data will be collected in the background, including when the App is minimised.
• You may disable Live Tracking at any time through the App.
• We are not responsible for any consequences arising from the public sharing of your location during events.

5. Event Data

Event registration data, results, and participation records are sourced from our systems and third-party event organisers. While we strive for accuracy, we do not guarantee that all event data is complete or error-free. Official results are determined by the event organisers.

6. Third-Party Services

The App integrates with third-party services including Strava, Sentry, and Mapbox. Your use of these integrations is subject to their respective terms of service and privacy policies. We are not responsible for the availability or practices of third-party services.

7. Intellectual Property

All content, branding, design, and software within the App are the property of Faces Events (Pty) Ltd or our licensors and are protected by applicable intellectual property laws. You may not copy, modify, distribute, or create derivative works without our prior written consent.

8. Disclaimer of Warranties

The App is provided "as is" and "as available" without warranties of any kind, whether express or implied. We do not warrant that the App will be uninterrupted, error-free, or free of harmful components. GPS accuracy may vary depending on device, environment, and network conditions.

9. Limitation of Liability

To the fullest extent permitted by South African law, Faces Events shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of the App, including but not limited to loss of data, revenue, or goodwill.

10. Indemnification

You agree to indemnify and hold harmless Faces Events, its directors, employees, and agents from any claims, damages, or expenses arising from your use of the App or violation of these Terms.

11. Modifications

We reserve the right to modify these Terms at any time. Changes will be effective upon posting the updated Terms within the App or on our website. Continued use of the App after changes constitutes acceptance of the revised Terms.

12. Governing Law

These Terms are governed by the laws of the Republic of South Africa. Any disputes shall be subject to the exclusive jurisdiction of the courts of South Africa.
